TERMS AND CONDITIONS FOR THE BURGER KING WEB APPLICATION

These Terms and Conditions shall apply to all orders of BURGER KING products (“Products”) of a customer through this BURGER KING web application (the “App”). By placing an order for Products through this App, you understand, agree with, and accept:

(i) these Terms and Conditions and any corresponding changes thereto which we may implement from time to time; and

(ii) our Privacy Policy in connection with how we process your personal information collected from this App.

For purposes of these Terms and Conditions, “BURGER KING”, “our” or “we” shall refer to PERF Restaurants, Inc., while “customer” or “you” shall refer to the customer who intends to purchase the Products from this App.

Territories Covered

You understand and agree that this App can only service the following areas, depending on the Order Fulfillment Option chosen. If your area is not within the areas below, you may visit the nearest BURGER KING store.

Delivery Area

BURGER KING offers delivery services only within selected areas. Each BURGER KING delivery branch has a dedicated delivery area which cannot be changed. Thus, any forced request for re-routing of order to another branch is strictly prohibited.

Serviceable coverage includes selected areas in Angeles, Antipolo, Baguio, Batangas, Bulacan, Cagayan de Oro, Cavite, Cebu, Davao, Iloilo, La Union, Laguna, Las Pinas, Makati, Malabon, Mandaluyong, Manila, Marikina, Misamis Oriental, Muntinlupa, Negros Occidental, Nueva Ecija, Pampanga, Paranaque, Pasay, Pasig, Quezon, Quezon City, San Juan, Taguig, Tarlac, Zamboanga, Bataan, Valenzuela, and Caloocan.

Account Creation

If you decide to place an order through this App, you will be asked to register by creating an account which requires your personal information such as name, complete delivery address, telephone or mobile number, email address and a password. Creating an account allows you to automatically fill-up necessary delivery details such as delivery address and contact number on your next order. Inputting and confirming a password on the “Guest Information” or “Sign Up” page of the App, along with other confirmations, allows you to make an account. You must keep this password confidential and must not disclose it to anyone. If you believe someone else knows your password, please change your password immediately.

We reserve the right to suspend your registration if you violate any of these Terms and Conditions.

When you choose to create an account by linking it with an external third party service or application, such as Facebook, this feature will not modify nor allow the access of the content of your Facebook account. However, if you use your Facebook account to create an account in this App, the following shall apply:

  • Your Facebook account name shall be your Account name in the App; and
  • The e-mail address of your Facebook account shall be your e-mail address in the App.

If you wish to order as guest, the App will require your name, telephone or mobile number and complete delivery address on every use of the ordering platform. The information you provide will only be used for purpose of the pertinent delivery and for any subsequent issues on payment. If you are ordering as a guest, do not input or confirm any password on the pertinent pages of the App.

You have the option to save your credit card details for seamless payment transactions. Credit card details are stored and processed by our service provider, Paymaya. You may manage saved credit card by: (1) adding credit card, (2) deleting saved credit card, or (3) setting a default credit card. Once you have saved your credit card details, you may pay using the same during check out without entering details such as the credit card number, expiration date and CVV. As part of the validation process, we will apply a test charge of Php10.00 when you save your credit card details. The test charge will be automatically triggered for voiding after validation of your credit card details. The option to save credit card details is applicable to registered users only.

If another person used your account to order Products on your behalf, with or without your knowledge, such order shall be subject to these Terms and Conditions, and you agree that the order shall be considered your own and will be charged to you.

If you indicate a recipient’s address other than your own, you agree that the order shall be considered your own and will be charged to you. If the payment is to be made by cash at the recipient’s address, you also agree that it is your responsibility to ensure that that the order is paid in full.

III. Fulfillment of Order

The online order submitted through this ordering platform will be fulfilled via delivery only. The delivery order is fulfilled either through riders or other third-party delivery services which we may engage. We reserve the right to revise or add order fulfillment options in the future

Submission of Order

Upon submission of your online order, you are authorizing us to process your online order and preparation of the Products you have specified on your order form. However, we reserve the right to refuse the processing of your order without any notification should we find any incorrect or incomplete details, or any previous spurious transactions with the given personal information.

Also, non-response to SMS and calls from either branch, or delivery rider may result to late or non-delivery of Products, or late preparation of the Products in store and should not be taken against us. Additional verification call or confirmation call may be required to proceed with your order.

Regular Order (Delivery)

By submitting your order via delivery through this App, you understand and agree that the processing of your order is subject to the following conditions:

1 . There is no minimum food purchase for a delivery transaction.

2. There is a forty-five (45) minute delivery guarantee for single receipt transactions amounting to PHP 3,000.00 and below. However, this delivery guarantee does not apply if there are more than 20 orders per transaction of the same product combinations.

You understand and accept, however, that any delay due to heavy traffic, inclement weather, unavoidable technical difficulties in the stores, or similar or conditions or circumstances, are beyond our control and should not at any time be taken against us. Delivery services may also not be available in cases of extreme weather, natural disasters, and unavoidable technical difficulties in the store/s in your area.

3. Orders above PHP 3,001.00 are considered bulk orders. For bulk orders, you will receive a call from our store to verify your identity and your order details. Due to the volume of the Products ordered, we do not guarantee that orders will be delivered within the forty-five (45) minute delivery period and the store will coordinate with you on the delivery serving time.

4. Excessive requests of items such as ketchup, condiments, utensils, and the like are subject to store discretion.

5. Any other special request outside the list of the BURGER KING product menu is strictly prohibited. Additional special request such as medicine, newspaper, cigarettes, grocery items, and the like will not be entertained.

VII. Advance Order

Delivery:

If you wish to order in advance through this App, you may place your order at least two (2) hours before your expected delivery time.

VIII. Order Acceptance and Confirmation

The acceptance of orders for the Products made through the App shall be at the entire discretion of BURGER KING. We reserve the right to decline to accept the order or deliver the Products without giving any reason.

For Delivery, our acceptance of an order occurs when you receive an on-screen message or email message

confirming that your order has been placed (“Delivery Order Confirmation”). The Delivery Order Confirmation is a record of our agreement to deliver the Products you ordered and your obligation to pay the price of the Products in full.

The Order Confirmation for Delivery will contain the following information:

Delivery

a. Your pertinent order ID;

b. The date and time of your order

c. The address to which your order will be delivered;

d. The BURGER KING branch that has received and will process your order; and

e. The contact number of the BURGER KING branch that has received and will process your order.

IX. Changes of Order

For Delivery, changes in your order or delivery time can be made within five (5) minutes from the time that you receive the Delivery Order Confirmation. Once confirmed, all orders are considered final.

If you wish to change your order prior to delivery, please call (through the contact number provided in the Order Confirmation) the store within the timeframe stated above, and provide the details of your order included in the Order Confirmation. Changes in your order that are confirmed by the pertinent store will reset the forty-five (45) minute delivery guarantee time, and will likewise be subject to these Terms and Conditions. You understand that the total amount of your order will be changed should there be any changes in your order, and that you agree to pay the new total amount upon delivery. Thus:

  • If you paid for your order online via credit card, any additional price difference as a result of changing your order must be paid in cash, payable upon delivery.
  • If, as a result of any change/s you make to your order, the total amount payable is less than the amount paid online via credit card, any amount paid in excess of the new total amount payable shall be refunded to you by your own bank. You understand and agree that in such a case, we will not process the refund on your behalf, and that you are personally responsible for processing the refund with your own issuing bank.
  • If you choose to pay by credit card upon delivery (card present), the total amount shall be chargeable and payable upon delivery.

If any of the changes to order include promotions which are only available for limited periods, any changes to your order may mean that the promotions are no longer available by the time the changes are made.__

We reserve the right to refuse any modification in case the order has already been dispatched for delivery prior to receipt of your request.

X. Cancellation of Orders

Delivery orders:

Orders may be cancelled within five (5) minutes from the time that you receive the Order Confirmation by calling or messaging the BURGER KING branch that received your order. Cancellation immediately after the fifth minute from the time that the Order Confirmation was received will no longer be valid. You understand and agree that cancellation beyond the fifth minute will require you to pay the full amount of the order you placed.

We reserve the right to refuse any cancellation in case the order has already been dispatched for delivery prior to receipt of your request.

If payment is made via credit card and the cancellation of order was successful, it will be your responsibility to contact the issuing bank to cancel the payment made

XI. Prices and Payment

Unless otherwise stated in writing, the Product prices quoted on this App are inclusive of value-added taxes and any other applicable taxes. The Product prices on this App are subject to change without prior notice.

You can pay by any of the following methods:

  • Cash upon delivery; and
  • Cashless mode of payment on-App (credit card and/or debit card), subject to the condition that on-App credit card payment may not be available all the time.

If your order is placed using a credit card, such card should be valid on the date of delivery of your order. You can also pay using your saved credit card.

A Senior Citizen (SC), Person with Disability (PWD), or National Athlete and Coach (NAC) discount may be applied on the delivery provided you comply with the Conditions stated below. SC, PWD, or NAC discount cannot be availed in conjunction with other discounts and/or promotions.

We reserve our right to refuse to deliver or prepare any order if for whatever reason we believe that payment will be refused at any stage.

XII. Refund

In case of a refund, any refund for payments made in cash would need to be processed by our Customer Services team by calling +63 2 8634 1111. Refunds for orders paid online via credit card or upon delivery via credit card must be processed by you through your issuing bank.

XIII. Delivery Conditions

You agree to accept delivery of the Products at the agreed time and place of delivery, subject to the specific delivery conditions below:

Delivery Time

The arrival time in our delivery service guarantee will be based on our rider’s arrival at the gate of your subdivisions, villages, factories, industrial areas, and other gated communities (as the case may be); while the arrival time in buildings, hospitals, condominiums, and hotels will be based on our rider’s arrival at the lobby.

We shall exert reasonable efforts to meet the guaranteed delivery time, where applicable. You understand and accept, however, that any delay due to traffic, inclement weather or similar or analogous conditions or circumstance, are beyond our control and should not at any time be taken against us.

Product Availability

You understand and agree that product/s are subject to availability at the time of delivery. If the products you ordered are not available, we may offer you a reasonable substitute product or equivalent quality and price or we may advise you through phone call (local Philippines), SMS, or electronic mail for alternative product/s. You understand that should you choose to order other product/s, this may affect the purchase price.

ID Validation

If a Senior Citizen (SC), Person with Disability (PWD), or National Athlete and Coach (NAC) discount was applied on the delivery transaction, the SC, PWD, NAC must be physically present at the time and place of the delivery, and the SC, PWD, or NAC card must be presented to our rider for validation.

Product Availability

You understand and agree that product/s are subject to availability at the time of pick up. If the products you ordered are not available, we may offer you a reasonable substitute product or equivalent quality and price or we may advise you through phone call (local Philippines), SMS, or electronic mail for alternative product/s. You understand that should you choose to order other product/s, this may affect the purchase price.

ID Validation

For credit card transactions payable upon take out / dine in, you will be requested to present a valid ID to our cashier for validation.

If a Senior Citizen (SC), Person with Disability (PWD), or National Athlete and Coach (NAC) discount was applied on the take out / dine in transaction, the SC, PWD, or NAC must be physically present at the time and place of take out / dine in, and the SC, PWD, or NAC card must be presented to the cashier for validation.

XV. Promotions, Coupons, and Rewards (Special Offers)

From time to time, products may be subject to special offers. Any special offer may be subject to these Terms and Conditions, unless otherwise specified by us. In case of inconsistency between the special offer and these Terms and Conditions, the former shall prevail. We reserve the right to change the conditions and/or availability of special offers or withdraw them at our discretion. However, we will honor any order received before the withdrawal or changes on the special offers. All special offers are valid only within the promotional period, are subject to change and are not valid in conjunction with other offers, unless otherwise stated.

For special offers made available through online coupons, these coupons may have separate mechanics and qualifiers which will be explicitly stated in each coupon. For you to successfully avail the coupon, you understand and acknowledge that you will follow the mechanics and qualifiers stated in each coupon, and that your failure to do so may result in your ineligibility or inability to avail the same. In such a case, you agree that we will not be liable for your ineligibility or inability to avail the coupon.

XVI. Limitation and Liability

We shall not be liable for any loss, expense, cost or damage arising directly or indirectly out of or in connection with: (i) your use of this site and/or application; or (ii) the delay beyond the estimated time or date of delivery or pick up; or (iii) availability of product/s at any given time; or (iv) force majeure; or (v) your ineligibility or inability to avail any special offer or coupon if you are unable to follow the relevant terms and conditions, or qualifiers/promo mechanics of such special offer or coupon; or (vi) any circumstances beyond our control, and over which we could not have avoided even with the exercise of reasonable care, or any indirect or unforeseeable loss suffered or incurred by customers or third parties. In any event, our liability for any given transaction shall not exceed the total price charged for the relevant items.

The Products ordered should be consumed immediately after their actual receipt. We will not be liable for any event that may arise as a result/consequence of consuming the Products beyond the specified time.

XVII. Intellectual Property

This site and/or application contains the BURGER KING and their logos, and other trademarks, service marks, product names, designs, titles, words or phrases, graphics and logos used in connection with the site and/or application (Collectively, the “Trademarks”), including, all text, images, photographs, illustrations, data, and/or other related information, and other materials featured, displayed, contained and available in and on the site and/or application (collectively, the “Content”), are owned by or licensed to BURGER KING.

The Trademarks, Content and related proprietary property are protected from copying and imitation under national and international laws and are not to be used, reproduced, adapted (whether in its original form or derivations thereof), or copied, in whole or in part, without the express written permission of BURGER KING. Third parties are not allowed to use the Trademarks and Content in any manner, or for any other purpose, commercial or otherwise, without BURGER KING’s prior express written consent.

XVIII. Privacy Policy

Our Privacy Policy, and any changes thereto which we may implement from time to time, in connection with how we process your personal information collected from this App may be found in the Privacy Policy. You agree that with your acceptance of these Terms and Conditions, you have read, understood, and accepted our Privacy Policy.

XIX. Updating these Terms and Conditions

Whenever necessary, we may, from time to time, update and/or revise these Terms and Conditions. We shall inform you of any update or revision by placing the date of the latest version on top of these Terms and Conditions.

XX.Miscellaneous Provisions

These Terms and Conditions shall be governed by and interpreted in accordance with Philippine law. In case of disputes, the venue for any action shall be the proper courts of Pasig City to the exclusion of all other venues.

Failure of BURGER KING to enforce a particular term or condition does not constitute a waiver of that term or condition by BURGER KING and shall not be construed as a waiver or variation of it or preclude its exercise at any subsequent time.

If any of the terms or conditions is held to be invalid or unenforceable, then such term or condition shall, so far as it is invalid or unenforceable, be given no effect and shall be deemed not to be included in these Terms and Conditions, but without invalidating any of the remaining provisions.

WHAT WE COLLECT

To fulfill your delivery orders, we shall collect the following personal information:

  • E-mail address;
  • Telephone Number/Mobile Number;

  • User name and password for the web application;

Order as Guest:

If you do not register/create an account nor give your email, but place an order with us through this website as a guest, we will ask for your full name, delivery address, e-mail address, and mobile number but will not keep the personal information provided. However, we will keep your order history (identified by the order ID number sent to your email address, without your corresponding personal information) for thirteen (13) months from the time such order was placed, for record purposes.

Browsing:

If you simply browse through our website but without registering an account, we do not collect any of your personal information.

WHAT WE DO WITH THE INFORMATION WE GATHER

We will process the information we have collected with your consent for the following purposes:

  1. to fulfill your delivery order;
  2. to understand your needs;
  3. to provide you with a better service, and
  4. internal record keeping, for the following reasons:
  • We may use the information to improve our products and services;

USER DATA DELETION UPON REQUEST

You may request for the deletion of your personal information in our secured internal database. The process is as follows:

    • Facebook and Apple account user name, e-mail address and mobile number (if you have elected to register using Facebook Sign In or Apple Sign In – iPhone users only);
    • Credit card information (if you have elected to save your credit card details); and

HOW WE COLLECT

Create an Account/Register:

We collect personal information once you register and create an account with us through this mobile application

You will also be registering an account by giving a password in the relevant space under the “Guest Information” page.

By registering and creating an account with us, you understand and agree that we shall use your personal information in accordance with this Privacy Policy.

For registered users, we may also request for other personal information such as birthday, gender and other demographic information like preferences and interests and other information relevant to customer surveys and/or offers. If you provide these information, you understand and agree that we will use such information for purposes described below in the What We Do With the Information We Gather section (i.e. for direct marketing purposes)

When you choose to create an account by linking it with your Facebook or Apple account (for iPhone users only), this feature will not modify nor allow access to the content of your Facebook or Apple account. However, the following shall apply:

-The account name of your Facebook or Apple account shall be used as your account name in the mobile application;

-The e-mail address of your Facebook or Apple account shall be used as your e-mail address in the mobile application; and

– The registered phone number of your Facebook or Apple account will also be used as your phone number in the mobile application.

Saving Credit Card Details:

You have the option to save your credit card details for seamless payment transactions. Credit card details are stored and processed by our accredited service provider. You may manage saved credit card by: (1) adding credit card, (2) deleting saved credit card, or (3) setting a default credit card. Once you have saved your credit card details, you may pay using the same during check out without entering details such as the credit card number, expiration date and CVV. As part of the validation process, we will apply a test charge of Php10.00 when you save your credit card details. The test charge will be automatically triggered for voiding after validation of your credit card details. The option to save credit card details is applicable to registered users only.

Signing up for Promotions and Online Offers:

During the registration process, you have the option to subscribe to marketing information from BURGER KING. By ticking the “I consent to receive promotional offers and marketing information from BURGER KING”, we will keep the e-mail address provided for purposes of sending you updates on exclusive offers.

Browsing:

If you simply browse through our mobile application but without registering an account, we do not collect any of your personal information

WHAT WE DO WITH THE INFORMATION WE GATHER

We will process the information we have collected with your consent for the following purposes:

  1. to fulfill your delivery order;
  2. to understand your needs;
  3. to provide you with a better service, and
  4. internal record keeping, for the following reasons:
  • We may use the information to improve our products and services;
  • We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided;
  • From time to time, we may also use your information to contact you for market research purposes; and
  • We may contact you by phone or mail. We may use the information to customize the mobile application according to your interests.

TERMS AND CONDITIONS FOR THE BURGER KING WEB APPLICATION

These Terms and Conditions shall apply to all orders of BURGER KING products (“Products”) of a customer through this BURGER KING web application (the “App”). By placing an order for Products through this App, you understand, agree with, and accept:

(i) these Terms and Conditions and any corresponding changes thereto which we may implement from time to time; and

(ii) our Privacy Policy in connection with how we process your personal information collected from this App.

For purposes of these Terms and Conditions, “BURGER KING”, “our” or “we” shall refer to PERF Restaurants, Inc., while “customer” or “you” shall refer to the customer who intends to purchase the Products from this App.

Territories Covered

You understand and agree that this App can only service the following areas, depending on the Order Fulfillment Option chosen. If your area is not within the areas below, you may visit the nearest BURGER KING store.

Delivery Area

BURGER KING offers delivery services only within selected areas. Each BURGER KING delivery branch has a dedicated delivery area which cannot be changed. Thus, any forced request for re-routing of order to another branch is strictly prohibited.

Serviceable coverage includes selected areas in Angeles, Antipolo, Baguio, Batangas, Bulacan, Cagayan de Oro, Cavite, Cebu, Davao, Iloilo, La Union, Laguna, Las Pinas, Makati, Malabon, Mandaluyong, Manila, Marikina, Misamis Oriental, Muntinlupa, Negros Occidental, Nueva Ecija, Pampanga, Paranaque, Pasay, Pasig, Quezon, Quezon City, San Juan, Taguig, Tarlac, Zamboanga, Bataan, Valenzuela, and Caloocan.

Account Creation

If you decide to place an order through this App, you will be asked to register by creating an account which requires your personal information such as name, complete delivery address, telephone or mobile number, email address and a password. Creating an account allows you to automatically fill-up necessary delivery details such as delivery address and contact number on your next order. Inputting and confirming a password on the “Guest Information” or “Sign Up” page of the App, along with other confirmations, allows you to make an account. You must keep this password confidential and must not disclose it to anyone. If you believe someone else knows your password, please change your password immediately.

We reserve the right to suspend your registration if you violate any of these Terms and Conditions.

When you choose to create an account by linking it with an external third party service or application, such as Facebook, this feature will not modify nor allow the access of the content of your Facebook account. However, if you use your Facebook account to create an account in this App, the following shall apply:

  • Your Facebook account name shall be your Account name in the App; and
  • The e-mail address of your Facebook account shall be your e-mail address in the App.

If you wish to order as guest, the App will require your name, telephone or mobile number and complete delivery address on every use of the ordering platform. The information you provide will only be used for purpose of the pertinent delivery and for any subsequent issues on payment. If you are ordering as a guest, do not input or confirm any password on the pertinent pages of the App.

You have the option to save your credit card details for seamless payment transactions. Credit card details are stored and processed by our service provider, Paymaya. You may manage saved credit card by: (1) adding credit card, (2) deleting saved credit card, or (3) setting a default credit card. Once you have saved your credit card details, you may pay using the same during check out without entering details such as the credit card number, expiration date and CVV. As part of the validation process, we will apply a test charge of Php10.00 when you save your credit card details. The test charge will be automatically triggered for voiding after validation of your credit card details. The option to save credit card details is applicable to registered users only.

If another person used your account to order Products on your behalf, with or without your knowledge, such order shall be subject to these Terms and Conditions, and you agree that the order shall be considered your own and will be charged to you.

If you indicate a recipient’s address other than your own, you agree that the order shall be considered your own and will be charged to you. If the payment is to be made by cash at the recipient’s address, you also agree that it is your responsibility to ensure that that the order is paid in full.

III. Fulfillment of Order

The online order submitted through this ordering platform will be fulfilled via delivery only. The delivery order is fulfilled either through riders or other third-party delivery services which we may engage. We reserve the right to revise or add order fulfillment options in the future

Submission of Order

Upon submission of your online order, you are authorizing us to process your online order and preparation of the Products you have specified on your order form. However, we reserve the right to refuse the processing of your order without any notification should we find any incorrect or incomplete details, or any previous spurious transactions with the given personal information.

Also, non-response to SMS and calls from either branch, or delivery rider may result to late or non-delivery of Products, or late preparation of the Products in store and should not be taken against us. Additional verification call or confirmation call may be required to proceed with your order.

Regular Order (Delivery)

By submitting your order via delivery through this App, you understand and agree that the processing of your order is subject to the following conditions:

1 . There is no minimum food purchase for a delivery transaction.

2. There is a forty-five (45) minute delivery guarantee for single receipt transactions amounting to PHP 3,000.00 and below. However, this delivery guarantee does not apply if there are more than 20 orders per transaction of the same product combinations.

You understand and accept, however, that any delay due to heavy traffic, inclement weather, unavoidable technical difficulties in the stores, or similar or conditions or circumstances, are beyond our control and should not at any time be taken against us. Delivery services may also not be available in cases of extreme weather, natural disasters, and unavoidable technical difficulties in the store/s in your area.

3. Orders above PHP 3,001.00 are considered bulk orders. For bulk orders, you will receive a call from our store to verify your identity and your order details. Due to the volume of the Products ordered, we do not guarantee that orders will be delivered within the forty-five (45) minute delivery period and the store will coordinate with you on the delivery serving time.

4. Excessive requests of items such as ketchup, condiments, utensils, and the like are subject to store discretion.

5. Any other special request outside the list of the BURGER KING product menu is strictly prohibited. Additional special request such as medicine, newspaper, cigarettes, grocery items, and the like will not be entertained.

VII. Advance Order

Delivery:

If you wish to order in advance through this App, you may place your order at least two (2) hours before your expected delivery time.

VIII. Order Acceptance and Confirmation

The acceptance of orders for the Products made through the App shall be at the entire discretion of BURGER KING. We reserve the right to decline to accept the order or deliver the Products without giving any reason.

For Delivery, our acceptance of an order occurs when you receive an on-screen message or email message

confirming that your order has been placed (“Delivery Order Confirmation”). The Delivery Order Confirmation is a record of our agreement to deliver the Products you ordered and your obligation to pay the price of the Products in full.

The Order Confirmation for Delivery will contain the following information:

a. Your pertinent order ID;

b. The date and time of your order

c. The address to which your order will be delivered;

d. The BURGER KING branch that has received and will process your order; and

e. The contact number of the BURGER KING branch that has received and will process your order.

IX. Changes of Order

For Delivery, changes in your order or delivery time can be made within five (5) minutes from the time that you receive the Delivery Order Confirmation. Once confirmed, all orders are considered final.

If you wish to change your order prior to delivery, please call (through the contact number provided in the Order Confirmation) the store within the timeframe stated above, and provide the details of your order included in the Order Confirmation. Changes in your order that are confirmed by the pertinent store will reset the forty-five (45) minute delivery guarantee time, and will likewise be subject to these Terms and Conditions. You understand that the total amount of your order will be changed should there be any changes in your order, and that you agree to pay the new total amount upon delivery. Thus:

  • If you paid for your order online via credit card, any additional price difference as a result of changing your order must be paid in cash, payable upon delivery.
  • If, as a result of any change/s you make to your order, the total amount payable is less than the amount paid online via credit card, any amount paid in excess of the new total amount payable shall be refunded to you by your own bank. You understand and agree that in such a case, we will not process the refund on your behalf, and that you are personally responsible for processing the refund with your own issuing bank.
  • If you choose to pay by credit card upon delivery (card present), the total amount shall be chargeable and payable upon delivery.

If any of the changes to order include promotions which are only available for limited periods, any changes to your order may mean that the promotions are no longer available by the time the changes are made.__

We reserve the right to refuse any modification in case the order has already been dispatched for delivery prior to receipt of your request.

X. Cancellation of Orders

Delivery orders:

Orders may be cancelled within five (5) minutes from the time that you receive the Order Confirmation by calling or messaging the BURGER KING branch that received your order. Cancellation immediately after the fifth minute from the time that the Order Confirmation was received will no longer be valid. You understand and agree that cancellation beyond the fifth minute will require you to pay the full amount of the order you placed.

We reserve the right to refuse any cancellation in case the order has already been dispatched for delivery prior to receipt of your request.

If payment is made via credit card and the cancellation of order was successful, it will be your responsibility to contact the issuing bank to cancel the payment made

XI. Prices and Payment

Unless otherwise stated in writing, the Product prices quoted on this App are inclusive of value-added taxes and any other applicable taxes. The Product prices on this App are subject to change without prior notice.

You can pay by any of the following methods:

  • Cash upon delivery; and
  • Cashless mode of payment on-App (credit card and/or debit card), subject to the condition that on-App credit card payment may not be available all the time.

A Senior Citizen (SC), Person with Disability (PWD), or National Athlete and Coach (NAC) discount may be applied on the delivery provided you comply with the Conditions stated below. SC, PWD, or NAC discount cannot be availed in conjunction with other discounts and/or promotions.

We reserve our right to refuse to deliver or prepare any order if for whatever reason we believe that payment will be refused at any stage.

XII. Refund

In case of a refund, any refund for payments made in cash would need to be processed by our Customer Services team by calling +63 2 8634 1111. Refunds for orders paid online via credit card or upon delivery via credit card must be processed by you through your issuing bank.

XIII. Delivery Conditions

You agree to accept delivery of the Products at the agreed time and place of delivery, subject to the specific delivery conditions below:

Delivery Time

The arrival time in our delivery service guarantee will be based on our rider’s arrival at the gate of your subdivisions, villages, factories, industrial areas, and other gated communities (as the case may be); while the arrival time in buildings, hospitals, condominiums, and hotels will be based on our rider’s arrival at the lobby.

We shall exert reasonable efforts to meet the guaranteed delivery time, where applicable. You understand and accept, however, that any delay due to traffic, inclement weather or similar or analogous conditions or circumstance, are beyond our control and should not at any time be taken against us.

Product Availability

You understand and agree that product/s are subject to availability at the time of delivery. If the products you ordered are not available, we may offer you a reasonable substitute product or equivalent quality and price or we may advise you through phone call (local Philippines), SMS, or electronic mail for alternative product/s. You understand that should you choose to order other product/s, this may affect the purchase price.

ID Validation

XV. Promotions, Coupons, and Rewards (Special Offers)

From time to time, products may be subject to special offers. Any special offer may be subject to these Terms and Conditions, unless otherwise specified by us. In case of inconsistency between the special offer and these Terms and Conditions, the former shall prevail. We reserve the right to change the conditions and/or availability of special offers or withdraw them at our discretion. However, we will honor any order received before the withdrawal or changes on the special offers. All special offers are valid only within the promotional period, are subject to change and are not valid in conjunction with other offers, unless otherwise stated.

For special offers made available through online coupons, these coupons may have separate mechanics and qualifiers which will be explicitly stated in each coupon. For you to successfully avail the coupon, you understand and acknowledge that you will follow the mechanics and qualifiers stated in each coupon, and that your failure to do so may result in your ineligibility or inability to avail the same. In such a case, you agree that we will not be liable for your ineligibility or inability to avail the coupon.

XVI. Limitation and Liability

We shall not be liable for any loss, expense, cost or damage arising directly or indirectly out of or in connection with: (i) your use of this site and/or application; or (ii) the delay beyond the estimated time or date of delivery or pick up; or (iii) availability of product/s at any given time; or (iv) force majeure; or (v) your ineligibility or inability to avail any special offer or coupon if you are unable to follow the relevant terms and conditions, or qualifiers/promo mechanics of such special offer or coupon; or (vi) any circumstances beyond our control, and over which we could not have avoided even with the exercise of reasonable care, or any indirect or unforeseeable loss suffered or incurred by customers or third parties. In any event, our liability for any given transaction shall not exceed the total price charged for the relevant items.

The Products ordered should be consumed immediately after their actual receipt. We will not be liable for any event that may arise as a result/consequence of consuming the Products beyond the specified time.

This site and/or application contains the BURGER KING and their logos, and other trademarks, service marks, product names, designs, titles, words or phrases, graphics and logos used in connection with the site and/or application (Collectively, the “Trademarks”), including, all text, images, photographs, illustrations, data, and/or other related information, and other materials featured, displayed, contained and available in and on the site and/or application (collectively, the “Content”), are owned by or licensed to BURGER KING.

The Trademarks, Content and related proprietary property are protected from copying and imitation under national and international laws and are not to be used, reproduced, adapted (whether in its original form or derivations thereof), or copied, in whole or in part, without the express written permission of BURGER KING. Third parties are not allowed to use the Trademarks and Content in any manner, or for any other purpose, commercial or otherwise, without BURGER KING’s prior express written consent.

XX.Miscellaneous Provisions

These Terms and Conditions shall be governed by and interpreted in accordance with Philippine law. In case of disputes, the venue for any action shall be the proper courts of Pasig City to the exclusion of all other venues.

Failure of BURGER KING to enforce a particular term or condition does not constitute a waiver of that term or condition by BURGER KING and shall not be construed as a waiver or variation of it or preclude its exercise at any subsequent time.

If any of the terms or conditions is held to be invalid or unenforceable, then such term or condition shall, so far as it is invalid or unenforceable, be given no effect and shall be deemed not to be included in these Terms and Conditions, but without invalidating any of the remaining provisions.

Usted, en su calidad de Usuario, al igual que cualquier otro Usuario, está prohibido de violar o intentar violar la seguridad de la App Mobile.

Al respecto, no podrá utilizar la App Mobile para realizar acciones que generen daños y/o perjuicios a Burger King, a Bolivian Foods S.A., a otros usuarios o a terceros, o para interferir con la actividad de la App Mobile o para violar normativa alguna.

Específicamente, usted en su calidad de Usuario, no podrá, de manera enunciativa y no limitativa:

(i) acceder a información que no esté dirigida o autorizada a usted o acceder a servidores o cuentas a los cuales no está autorizado a acceder, incluida información personal de otros usuarios sin el consentimiento expreso de éstos;

(ii) intentar probar la vulnerabilidad de un sistema o red sin contar con la debida autorización o violar las medidas de seguridad o de autenticación;

(iii) intentar interferir con los servicios prestados a usted, a otros Usuarios, servidor o red, incluyendo, pero sin limitarse, el cargado o transmisión de virus informáticos a través de la App Mobile o sobre carga de tráfico para denegación del servicio;

(iv) enviar correos electrónicos no solicitados, incluyendo promociones y/o publicidad de productos o servicios.

La violación de cualquier sistema o red de seguridad puede resultar en responsabilidades civiles y penales. Bolivian Foods S.A. podrá encargar a profesionales o peritos especializados la investigación sobre la ocurrencia de hechos que puedan constituir violaciones a lo anteriormente señalado y cooperará con cualquier autoridad competente en la persecución de los Usuarios que estén envueltos en tales violaciones;

(v) suplantar la identidad de otros usuarios o de personas naturales o jurídicas de cualquier índole;

(vi) proporcionar información de identidad incorrecta, incompleta o falsa;

(vii) bajo ninguna circunstancia se tolerará la acción de hacer pedidos falsos o crear usuarios con fines fraudulentos, acciones que serán denunciadas y estarán sujetas a las prosecuciones legales aplicables.

La App Mobile debe ser utilizada únicamente para propósitos lícitos y propios de las funcionalidades para las que ha sido creada.

5. ADQUISICIÓN Y DESCARGA

Los presentes Términos y Condiciones regulan las condiciones para la adquisición/descarga de la App Mobile a su dispositivo smartphone, tableta y/o iPhone con iOS 11.0 o superior o Android sistema operativo 5.0 o superior, conectado a través de la red internet. La App Mobile, una vez descargada, permitirá el acceso y uso de algunas funcionalidades de la App Mobile de Burger King únicamente si completa su registro.

La descarga de la App Mobile habilita a usted, como Usuario, a acceder a cupones exclusivos para Mobile (en adelante, el/los “Cupones”), previo registro como Usuario y contraseña.

Al descargar, registrarse e ingresar a la App Mobile, usted podrá acceder a un listado de cupones de entre los cuales podrá seleccionar el que sea de su interés (ingresando a la imagen digital del cupón seleccionado y haciendo un click en la frase “Obtener Cupón”).

Al utilizar y descargar los Cupones, usted reconoce que ha revisado y comprende nuestros “Términos y Condiciones para Cupones” y acepta las condiciones descritas en los mismos.

5.1 Condiciones de la Licencia de Software

a. La descarga de la App Mobile y/o las funcionalidades previstas o que en el futuro se puedan permitir a través de la App Mobile, tendrá/n carácter gratuito, sin perjuicio de que la conexión, navegación, uso de datos y llamada/s que, en su caso, usted, en su calidad de Usuario realice y serán facturadas por su operador según la tarifa que tenga contratada.

No obstante, Burger King, por intermedio de su franquiciatario Bolivian Foods S.A. se reserva el derecho de introducir en el futuro alguna contraprestación, lo cual será comunicado con antelación suficiente.

b. En virtud del presente documento, Burger King otorga y usted, en su calidad de Usuario, acepta una licencia de uso gratuito del Software de propiedad de Burger King Corp., administrado en Bolivia por su franquiciatario Bolivian Foods S.A.. Dicha licencia es personal e intransferible, limitada, no exclusiva y disponible tras la aceptación de los presentes Términos y Condiciones, a través de un proceso de descarga telemática para acceder directamente a la página de inicio desde la que se posibilitará el acceso a las funcionalidades puestas a su disposición a través de la App Mobile.

c. La utilización del Software queda restringida al uso anteriormente señalado y su empleo para cualquier otro fin queda expresamente prohibido y será considerado como acto de piratería de software que infringe las leyes de propiedad intelectual e industrial, de tal forma que Burger King Corp. o Bolivian Foods S.A. indistintamente puedan demandar responsabilidad por el incumplimiento de esta condición según la normativa vigente. Asimismo, queda expresamente prohibida la manipulación del software de manera total o parcial por usted o por terceros.

d. Asimismo, la totalidad de la App Mobile, es decir, los elementos que la componen (textos, imágenes, marcas, logotipos, archivos de audio, archivos de software, combinaciones de colores), así como la estructura, selección y orden de sus contenidos, se encuentran protegidos por la normativa de Propiedad Intelectual e Industrial, no pudiendo ser objeto de explotación, reproducción, distribución, modificación, comunicación pública, cesión o transformación o cualquier otra forma de difusión no autorizada expresamente.

El acceso a la App Mobile no otorga al Usuario derecho ni titularidad alguna sobre los derechos de propiedad intelectual y/o industrial de los contenidos que alberga.

Burger King Corp y/o Bolivian Foods S.A., se reservan el derecho de ejercer las acciones legales que correspondan contra el Usuario que viole o infrinja sus derechos de propiedad intelectual y/o industrial.

e. Usted, en su calidad de Usuario, será responsable de comprobar que el Software es compatible con su Dispositivo, por lo que asume los daños que la utilización del Software, incluida su instalación, pudiera ocasionar en su dispositivo.

f. Corresponde a usted, en calidad de Usuario, la obtención de los dispositivos apropiados para los fines establecidos en estos Términos y Condiciones y las líneas de comunicación, así como de aceptar el consumo producido por la utilización de la red de datos, siendo de su cuenta su adquisición y los gastos que pudieran derivarse de los mismos. Asimismo, es su responsabilidad exclusiva comprobar, con carácter previo a realizar una descarga, las funcionalidades del Software, así como la idoneidad para atender sus necesidades con esto Términos y Condiciones y la compatibilidad con su sistema.

g. Burger King Corp. no otorga ningún tipo de garantía sobre el Software proporcionado.

En ningún caso, Burger King Corp. o su franquiciatario Bolivian Foods S.A. serán responsables de las pérdidas, daños o perjuicios de cualquier tipo que surjan por acceder y usar la App Mobile y/o el equipo en donde se encuentre instalada la misma, incluyéndose, pero no limitándose, a los producidos en los sistemas informáticos por la introducción de virus y/o ataques informáticos. Burger King Corp. Y su franquiciatario Bolivian Foods S.A. tampoco serán responsables de los daños que pudieran sufrir los Usuarios por un uso inadecuado de la App Mobile y, en modo alguno, de las caídas, interrupciones, ausencia o defecto en las telecomunicaciones. Se incluye el uso no autorizado de la App Mobile por parte de menores de edad en los dispositivos de usted, en su calidad de Usuario y único responsable del buen uso y manejo de su dispositivo.

h. Burger King Corp., por intermedio de su franquiciatario Bolivian Foods S.A. se reserva el derecho a realizar modificaciones y/o mejoras en el Software, en cualquier momento y sin previo aviso, que pasarán a ser propiedad exclusiva de la compañía.

5.2 Respecto de la información facilitada a través de la App Mobile, debe ser considerada por usted en su calidad de Usuario como introducción, sin que pueda estimarse como elemento determinante para la toma de decisiones, declinando Burger King Corp. y/o Bolivian Foods S.A. toda responsabilidad por el uso que pueda verificarse de la misma en tal sentido.

5.3 Usted, en su calidad de Usuario, tendrá la posibilidad de acceder a funcionalidades provista por la App Mobile de Burger King mediante las cuales se le permita realizar pedidos a los Restaurantes de Burger King. Asimismo, tendrá la opción de abonar los productos de su pedido al retirarlos de un restaurante de Burger King o bien, abonarlos previamente a través de la App Mobile.

Para pagar los productos a través de la App Mobile, deberá ingresar información relacionada con su tarjeta de crédito o instrumento de pago y ordenar el pago a través de la misma en cada transacción. Usted, en su calidad de Usuario, declara y garantiza que dicha información será correcta y que es titular y/o que se encuentra expresamente autorizado para utilizar el medio de pago en la App Mobile.

5.4 Los presentes Términos y Condiciones se formalizan única y exclusivamente entre el Usuario y Burger King, y no con el Fabricante o Distribuidor.

El Fabricante o Distribuidor no será responsable del Software ni de su contenido. Si los presentes Términos y Condiciones fueran más restrictivos o entraran en conflicto con las condiciones de uso establecidas en el correspondiente store, estas últimas tendrán validez sobre las anteriores si La licencia que se otorga en virtud de los presentes Términos y Condiciones se limita a una licencia intransferible para utilizar la App Mobile en un Dispositivo de titularidad o bajo el control de usted en su calidad de Usuario y, en todo caso, bajo los términos autorizados por el Fabricante o Distribuidor en las Condiciones de Uso de su store.

5.5 La App Mobile recoge información estadística de los Cupones y funcionalidades utilizadas por los Usuarios mediante el almacenamiento de información en el Dispositivo del Usuario. La citada información, consiste en fecha y hora, tipo de Dispositivo, ubicación y registro de errores.

La información recogida se utilizará para adquirir mayor conocimiento sobre la actividad de los usuarios de la App Mobile, en aras de mejorar la misma y aumentar la efectividad de su presencia on-line. Para recabar dicha información y someterla a un tratamiento estadístico para Burger King, se utilizan servicios de Internet ello implica que la App Mobile enviará al servidor dicha información.

5.6 SERVICIO DE GEOLOCALIZACIÓN:

Usted, en su calidad de Usuario, acepta utilizar este Servicio exclusivamente con propósitos lícitos, adecuados y de acuerdo con estos Términos y Condiciones, así como con las determinadas por cada proveedor de Software de geolocalización (Proveedores de Software de Geolocalización) en su correspondiente página web. A modo de ejemplo, y sin limitarse a ello, cuando usted utilice este Servicio, acepta:

– no difamar, abusar, acosar, acechar, amenazar ni infringir de ningún otro modo los derechos legales (como derechos de privacidad y publicidad) de Burger King Corp. de Bolivian Foods S.A., Burger King y de cualquier otra persona natural o jurídica sin excepción,

– no subir, publicar, enviar por correo electrónico, transmitir ni poner a disposición de otros usuarios de ningún otro modo contenido inadecuado, difamatorio, infractor, obsceno o ilegal,

– no subir, publicar, enviar por correo electrónico, ni facilitar contenido que infrinja patentes, marcas comerciales, derechos de autor, secretos comerciales u otros derechos de propiedad de Burger King Corp., y/o de Bolivian Foods S.A., a menos que sea el propietario de los derechos del contenido o que el propietario de dicho contenido le haya otorgado el permiso pertinente para tal efecto,

– no subir, publicar, enviar por correo electrónico ni facilitar mediante ningún otro medio mensajes que promocionen esquemas piramidales, cartas en cadena, así como mensajes o publicidad negativa o cualquier otra acción prohibida por la ley, las presentes Condiciones de servicio o las políticas o directrices aplicables,

– no descargar archivos publicados por un tercero que usted sepa, o sobre los que existan razones fundadas para saber, que no se pueden distribuir legalmente de tal manera,

– no hacerse pasar por ninguna otra persona o entidad, ni falsificar ni eliminar atribuciones de autor, avisos legales o ningún otro aviso pertinente o designación de autoría, así como etiquetas en las que conste el origen o la fuente del software u otro material,

– no restringir ni impedir a otros usuarios el uso y disfrute de los servicios de los Proveedores de Servicios de Geolocalización,

– no utilizar los servicios de los Proveedores de Servicios de Geolocalización para ningún propósito ilegal o no autorizado,

– no eliminar avisos de derechos de autor, marca comercial o derechos sobre la propiedad que se incluyan en los servicios de los Proveedores de Servicios de Geolocalización,

– no interferir con los servicios o servidores o redes de los Proveedores de Servicios de Geolocalización conectados a los servicios de los Proveedores de Servicios de Geolocalización, respectivamente, o interrumpir aquellos, o ignorar cualquier tipo de requisito, procedimiento, política o regulación de redes conectadas a los servicios de ambas compañías,

– no utilizar robots, arañas, aplicaciones de búsqueda/recuperación de sitios o cualquier otro dispositivo para recuperar o indexar cualquier parte de los servicios de los Proveedores de Servicios de Geolocalización o para recuperar información acerca de los usuarios a fin de utilizarla con propósitos no autorizados,

– no enviar contenido que exprese de forma falsa o insinúe que dicho contenido está patrocinado o respaldado por los Proveedores de Servicios de Geolocalización,

– no crear cuentas de usuario a través de métodos automatizados o con pretensiones falsas o fraudulentas,

– no promover ni ofrecer instrucciones sobre actividades ilegales, ni tampoco fomentar lesiones o daños físicos a grupos o individuos,

– no transmitir virus, gusanos, defectos y troyanos, así como otros elementos con fines destructivos.

6. PROPIEDAD INTELECTUAL

Todo el contenido, código, software y cualquier otro material que forme parte de la App Mobile es propiedad de Burger King Corp. y será administrado en Bolivia por su franquiciatario Bolivian Foods S.A.

Usted, en su calidad de Usuario, puede utilizar la App Mobile sólo para uso no comercial, informativo, personal, sin modificaciones y únicamente en tanto cumpla con estos Términos y Condiciones.

Derechos de Autor. El contenido de la App Mobile, incluyendo, pero sin limitarse a los textos, gráficas, imágenes, logotipos, íconos, software y cualquier otro material (en adelante el “Material”) está protegido bajo la normativa nacional y supranacional de propiedad industrial y propiedad intelectual.

Todo el material producido, utilizado y difundido es de propiedad de Burger King Corp. y queda terminantemente prohibido modificar, copiar, reutilizar, extraer, explotar, reproducir, comunicar al público, hacer segundas o posteriores publicaciones, cargar o descargar archivos, enviar por correo, transmitir, usar, tratar o distribuir de cualquier forma la totalidad o parte de los contenidos incluidos en la App Mobile. El uso no autorizado del material puede constituir una violación de las leyes sobre derechos de autor, leyes de propiedad industrial u otras leyes. Usted, ni ningún otro Usuario podrán vender o modificar el material, ni ejecutar o anunciar públicamente el mismo, ni distribuirlo para propósitos comerciales. Tampoco se permite copiar o adaptar el código de la App Mobile. Todo uso no autorizado se presumirá como indebido y podrá ser sancionado por la ley.

Marcas Comerciales. “Burger King”, el logotipo de Burger King, y otras marcas indicadas en la App Mobile son marcas comerciales de Burger King Corporation con derechos reservados de uso para Bolivian Foods S.A. en Bolivia. Otros gráficos, logotipos, encabezados de página, íconos de botones, guiones y nombres de productos de Burger King son marcas comerciales o imágenes comerciales de Bolivian Foods S.A. Las marcas comerciales e imagen comercial conferidas a Bolivian Foods S.A., incluyendo pero no limitando: Burger King, BK, Whopper cuyo titular es Burger King Corporation, no pueden ser utilizadas sin el correspondiente consentimiento expreso.

7. PUBLICACIONES DE LOS USUARIOS

La App Mobile puede permitir a los Usuarios realizar publicaciones y comentarios, enviar correos electrónicos o enviar información a Burger King y/o a otros Usuarios (en adelante las “Publicaciones”). Usted, en su calidad de Usuario, será el único responsable de sus Publicaciones y su contenido incluida la información, grabaciones de audio, videos, fotografías, documentos o cualquier otro material. Usted acepta y se obliga a no realizar Publicaciones que:

– Violen derechos de autor, marcas registradas, patentes u otro derecho de propiedad intelectual de cualquier persona o entidad;

– Sean falsas, engañosas, difamatorias, obscenas, abusivas, amenazantes, acosadoras o sexualmente explícitas;

– Violen el derecho a la privacidad o publicidad de cualquier persona o entidad;

– Ataquen personalmente o se hagan pasar por otra persona o entidad, o declaren falsamente o tergiversen de alguna otra manera una afiliación con una persona o entidad;

– Degraden a otros por motivos de género, raza, clase, etnia, origen nacional, religión, preferencia sexual, orientación o identidad, discapacidad u otra clasificación;

– Transmitan, almacenen o transmitan virus, caballos de troya, gusanos, spyware, bots o cualquier otra rutina de programación dañina;

– Pongan a disposición material de naturaleza comercial o envíen, hagan o permitan el envío de mensajes electrónicos comerciales, incluidos, entre otros, publicidad, promociones, correo basura, spam, esquemas piramidales, cartas en cadena o solicitudes de cualquier tipo;

– Violen cualquier ley aplicable, alienten o defiendan una actividad ilegal.

Bolivian Foods S.A. no controla las publicaciones de los Usuarios y no se hace responsable de dichas Publicaciones.

Bolivian Foods S.A. se reserva el derecho a retirar Publicaciones que incumplan los presentes Términos y Condiciones.

Si usted, en su calidad de Usuario considera que su Publicación ha sido copiada de forma que constituya una infracción de los derechos de autor y propiedad intelectual, debe notificarlo a info@burgerking.com.bo

Al enviar o mostrar Publicaciones a través de la App Mobile, usted, en su calidad de Usuario, otorga a Bolivian Foods S.A. una licencia mundial, no exclusiva, libre del pago de derechos (con derecho a sublicencia) para usar, copiar, reproducir, procesar, adaptar. modificar, publicar, transmitir, mostrar y distribuir dichas Publicaciones en todos y cada uno de los medios de comunicación o métodos de distribución posibles, conocidos ahora o desarrollados con posterioridad (a efectos aclaratorios, estos derechos incluyen, por ejemplo, los de organización, transformación y traducción).

Esta licencia autoriza a Bolivian Foods S.A. a poner las Publicaciones a disposición del resto del mundo y a permitir que otros hagan lo mismo. Usted acepta que esta licencia incluye el derecho a proporcionar, promover y mejorar la App Mobile y a poner las Publicaciones enviadas a o a través de la misma a disposición de otras empresas, organizaciones o personas para la sindicación, emisión, distribución, promoción o publicación de dicho contenido en otros medios y servicios, sujeto a estos Términos y Condiciones.

8. LINKS Y CONTENIDO DE TERCEROS

La App Mobile puede contener links a sitios webs o redes que estén bajo el control de terceros distintos a Burger King Corp. o Bolivian Foods S.A., quienes no se hacen responsables del contenido que se muestra en dichos sitios o redes y de las personas o usuarios asociadas a ellos. Los presentes Términos y Condiciones, no se aplican a dichos sitios webs o redes.

Se recomienda a los Usuarios revisar las políticas de privacidad y los términos y condiciones de los sitios de internet y redes de terceros.

9. CANCELACIÓN

Burger King Corp., por intermedio de su franquiciatario en Bolivia, Bolivian Foods S.A., se reserva el derecho a restringir, suspender o cancelar el acceso de usted, en su calidad de Usuario o de otros Usuarios a sus sitios web, sin estar obligado a comunicar o exponer las razones de su decisión y sin que ello genere indemnización alguna o resarcimiento a favor suyo o de terceros.

10. LEY APLICABLE Y JURISDICCIÓN

Los presentes Términos y Condiciones, así como la relación que vincula a los Usuarios con Burger King, se encuentran regidos por la legislación vigente en el Estado Plurinacional de Bolivia.

Cualquier controversia derivada de la utilización de los sitios web de Bolivian Foods S.A. o los que estuvieran bajo su representación o administración o de los presentes Términos y Condiciones, su existencia, validez, interpretación, alcance o cumplimiento, serán sometidos ante los jueces civiles comerciales con sede en el Departamento en el que Bolivian Foods S.A. cuente con restaurantes BK dentro del territorio del Estado Plurinacional de Bolivia y en los que se haya suscitado la controversia.

11. NOTIFICACIONES

Bolivian Foods S.A. podrá realizar notificaciones a usted, en su calidad de Usuario a través de una notificación general en los sitios web de su propiedad o bajo su representación o administración, a través de mensaje de texto y/o dirección de correo electrónico que nos ha facilitado.

POLÍTICA DE PRIVACIDAD

Fast Food Chile S.A., (en adelante “Burger King”) y sus socios comerciales se preocupan por las inquietudes sobre la privacidad de quienes visitan su aplicación móvil “Burger King Chile” (en adelante la “App Móvil”). El objetivo de esta Política sobre la Privacidad (en adelante “Política de Privacidad”) es describir qué tipo de información recopilamos de quienes descargan nuestra App Mobile administrada por Burger King, el destino de dicha información, sus derechos respecto de la información personal provista y a quién y en qué casos se divulga la información. Esta Política de Privacidad se aplica a la práctica de recopilación, almacenamiento, uso y divulgación de la información a las personas que visiten cualquier sitio web de Burger King, en adelante, el o los “Sitios”.

Mediante el uso de la App Móvil y la visualización de este Sitio, usted, el “Usuario”, presta su consentimiento para la recopilación de información, prácticas de uso y divulgación de información que se describen en esta política de privacidad.

Administradores

La App Móvil es administrada por Burger King y algunos proveedores de servicios de Burger King y sus subsidiarias, como proveedores de servicios de publicidad, promociones, acceso a Internet y relaciones públicas, entre otros (citados aquí colectivamente como “Proveedores de Servicios”). En este aviso, Burger King y los Proveedores de Servicios se denominan colectivamente como “Nosotros” y “nuestro(s)”. Los Proveedores de Servicios administran y ofrecen atención a clientes para la App Móvil.

Burger King es responsable del proceso de recopilación de datos personales de los Usuarios que participen en la App Móvil, en cumplimiento con la presente Política de Privacidad, la Ley de Protección de Datos Personales y sus normas reglamentarias.

RECOPILACIÓN DE INFORMACIÓN

Información no personal

Cierta información no personal acerca de quienes visitan la App Móvil se graba conforme a los métodos estándar de los servidores de Internet en los que se administra la App Móvil. La información no personal que recopilamos puede comprender el tipo de sistema operativo en uso (por ejemplo, GNU/Linux, OSX o Windows), el tipo de navegador que el visitante usa (por ejemplo, Chrome, Firefox, Safari o Internet Explorer) y el número y la frecuencia con la que visita la App Móvil.

Cuando los Usuarios visitan y/o descargan la App Móvil, podemos recopilar cierta información no personal sobre ellos, por medio del uso de archivos de texto pequeños conocidos como “cookies”. Las cookies se usan con diversos fines, como, por ejemplo, reconocer a nuestros visitantes para determinar la cantidad de visitantes nuevos a nuestra App Móvil, de nuestros Sitios y saber qué páginas consultan. Es posible que la información que recopilamos por medio de cookies se relacione con datos personales que recopilamos en línea. También es posible que permitamos a terceros no afiliados a Burger King o sus Proveedores de Servicios instalar cookies en el disco duro de la

 

computadora de quienes visitan nuestra App Móvil. Ustedes siempre tendrán la libertad de rechazar las cookies, pero al hacerlo es posible que no puedan utilizar ciertas funciones de nuestra App Móvil. En la mayoría de los navegadores, la opción de “ayuda” de la barra de herramientas muestra cómo configurar el navegador para rechazar cookies nuevas, cómo hacer que el navegador te avise cuando reciba una cookie nueva y cómo eliminarlas del disco duro.

También podemos hacer uso de los monitores de acceso a fin de contar con el número de visitas al Sitio por parte de nuestros Usuarios, consultar las cookies y mejorar la experiencia al visitar nuestra App Móvil.

Información Personal

En términos generales, sólo recopilamos la información y datos personales que el Usuario nos proporcione voluntariamente. Estos datos personales incluyen, en particular, la siguiente información: Nombre, Apellido y dirección de correo electrónico, domicilio o residencia, contraseña (encriptada), teléfono, pedido de restaurante, dirección de IP, datos de localización de GPS y números de cupones.

Al suministrar voluntariamente información y datos personales, usted está de acuerdo y acepta que Nosotros podemos recabar, utilizar y compartir su información personal de acuerdo con esta política de privacidad y la Ley N°19.628 sobre Protección de Datos Personales (“Ley de Datos Personales”). Asimismo, según el caso, se podrán obtener autorizaciones o consentimientos específicos de vez en cuando. Jurisdicción y Ley Aplicable

APLICACIÓN BURGER KING Términos de Uso

1. General

1.1 Estos términos de uso forman la base contractual entre Burger King y el Cliente/Usuario (Usted) para el uso del servicio y las aplicaciones (como se define a continuación) y cualquier servicio asociado. En este contexto, los pedidos se pueden realizar a través de (1) la aplicación “Burger King Chile” (de ahora en adelante “APP Móvil”) para descargarse en su teléfono móvil (teléfono inteligente); (2) a través de una aplicación web en nuestro sitio web (www.burgerking.cl); (3) mediante una aplicación en uno de nuestros «quioscos de auto-pedido». Con dichos pedidos, también puede acumular puntos que puede canjear por recompensas como se describe en la Sección 7 a continuación. 1.4 Utilizamos MENU Technologies AG (en adelante “MENU”) como proveedor de servicios externo para la ejecución de pedidos y procesamiento de pagos. Sin embargo, usted no entabla una relación contractual con MENU.

1.5 La recopilación y el procesamiento de datos personales en relación con el servicio se lleva a cabo de acuerdo con nuestra declaración de protección de datos en la “Política de Privacidad”.

2. Servicio

2.1 Puede ser utilizado a través de la APP Móvil descargada a su teléfono móvil (teléfono inteligente), a través de una aplicación web en un sitio web (www.burgerking.cl) o mediante una aplicación en un quiosco de auto atención, todos ellos tienen la oportunidad de acceder a la información del menú del restaurante específico a través de la solicitud de pedidos de comidas, bebidas u otro consumo. 2.3. Por medio de la aceptación de los Términos de Uso, Usted autoriza a Burger King a divulgar y procesar sus pedidos, datos personales y, en particular, sus datos de ubicación a los restaurantes participantes.

3. Cuenta de Usuario

3.1 Para que pueda utilizar el Servicio o la APP Móvil, en particular para realizar un pedido en la aplicación proporcionada por Burger King, primero debe iniciar sesión y crear una cuenta de Usuario. Actualmente, esto es posible en la aplicación Burger King Chile, a través del sitio web (www.burgerking.cl), pero no es posible en el quiosco de auto atención.

5. Uso del Servicio

  • Conservará la contraseña de su cuenta de Usuario o cualquier identificación que le proporcionemos para obtener acceso al servicio y las aplicaciones de forma segura y confidencial y mantenerla en secreto.
  • Nos proporcionará cualquier prueba de su identidad que consideremos apropiada.
  • No utilizará el servicio o las aplicaciones con un dispositivo no compatible o no aprobado.

5.3 Burger King se reserva en particular el derecho de cancelar inmediatamente el Servicio y el uso de la APP Móvil o de otras aplicaciones relacionadas, si no cumple con todas las obligaciones establecidas anteriormente.

5.4 Usted es responsable de la correcta instalación y funcionamiento de las aplicaciones en sus dispositivos y del acceso a la red de datos requerido para poder utilizar el Servicio y las aplicaciones, así como los costos que pudieran derivarse del uso del servicio y las aplicaciones. Al acceder y / o utilizar el Servicio y las aplicaciones, se pueden generar tarifas y cargos de datos y conexión, por ejemplo, los cargos de su proveedor de red móvil, siendo Usted es el único responsable de pagarlos.

6. Pago

7. Acumule y canjee puntos

Los puntos sólo podrán ser utilizados para compras de productos Burger King a través de la APP Móvil. Para acreditar puntos, debe iniciar sesión en las aplicaciones con su cuenta de Usuario en el momento de realizar el pedido u otro uso de las aplicaciones. Los puntos utilizados no son reembolsables.

7.2 Si una compra por la que ha recibido puntos no se materializa, o si la compra se revierte posteriormente (por ejemplo, mediante cancelación, retiro, cancelación del contrato, impugnación, etc.), Burger King se reserva el derecho de cancelar también el crédito de puntos correspondiente.

7.3 Burger King acreditará los puntos que haya acumulado en una cuenta de puntos administrada por Usted. No es posible pagar puntos en efectivo.

8. Licencia y restricciones

8.2 No se le permite a Usted ni a ningún tercero: (i) eliminar referencias a derechos de autor, marcas comerciales u otros derechos de propiedad de la parte relevante de las aplicaciones; (ii) reproducir, modificar, crear, distribuir, licenciar, alquilar, vender, revender, transferir, transmitir, hacer públicas o utilizar de otro modo las aplicaciones sin el consentimiento expreso de MENÚ para transmitir, transmitir o explotar de otro modo; (iii) descompilar, realizar ingeniería inversa o desensamblar las

aplicaciones, a menos que y en la medida que lo permita la ley; (iv) vincular, enmarcar o reflejar una parte de las aplicaciones; (v) para desarrollar o instalar programas o scripts con el objetivo de raspar, indexar, inspeccionar u otro tipo de minería de datos o para restringir u obstaculizar indebidamente la operación o función de aspectos de las aplicaciones; o (vi) intentar obtener o interferir con el acceso no autorizado a cualquier parte de las aplicaciones y los sistemas o redes conectados a ella.

8.3 El Servicio, la APP Móvil y las aplicaciones, así como todos los derechos sobre el mismo, pertenecen exclusivamente a MENÚ o los licenciantes de MENÚ y permanecen con ellos.

8.4 Ni estos Términos de Uso ni el uso del Servicio le otorgan ningún derecho: (i) hacia o en relación con el Servicio, a la APP Móvil o las aplicaciones, excepto por la licencia limitada otorgada anteriormente; o (ii) al uso o referencia a los nombres de empresas, logotipos, marcas u otras marcas comerciales de MENÚ o Burger King, o de los licenciatarios de MENÚ o Burger King.

8.5 El Servicio, la APP Móvil o las aplicaciones pueden hacerse accesibles o utilizarse en conexión con o en conexión con servicios y / o contenido de terceros (incluida la publicidad). 9. Contenido de Usuario
